It shall be the duty of every claimant's solicitor to consider, from the earliest practicable stage, whether it is likely or possible that early intervention, rehabilitation or medical treatment would improve their well-being.

The Ministry of Justice CPR Rehabilitation Code

 

The Rehabilitation Code is recognised by insurers and is designed to ensure that the claimant's quality of life is paramount in the claims process.


The inclusion of the Rehabilitation Code in the CPR protocols means that solicitors have an obligation to consider as early as possible whether the claimant has reasonable needs that could be met by rehabilitation treatment.

How does it work?


We will work with you to create a rehabilitation protocol that suits your firm. A typical protocol would be as follows:

  • You instruct us on each PI case as soon as you have the letter of claim returned to you (we can help you set up electronic links to automate this process)
  • We will contact the claimant by telephone to undertake a telephone assessment designed to aid the diagnostic process and ascertain whether we feel the claimant would benefit from an in-person assessment from one of our rehab practitioners.
  • Should our doctor recommend this to be the case we will contact the claimant to arrange for this to happen as soon as possible at a convenient time and location
  • The practitioner will complete an Initial Assessment form detailing the claimant's injuries and, where applicable, recommending a course of treatment.
  • We provide you with all the information and correspondence to apply for an interim payment from the insurer
  • On the completion of treatment, the practitioner will complete a discharge form which can be submitted to the third party and also made available for comment by the expert in their report
  • Once you have received payment from the third party, you will, in turn, pay our invoices
